This Last Will and Testament template can be used to outline the disbursement of a person’s estate and can be easily tailored for your personal use.  ... more>>In this case the word will is used as a general term, while the word testament applies only to dispositions of personal property. If a person does not have a will and dies, courts and attorneys can only guess what the wishes of the deceased person might have been. This means it will be the courts, and not the deceased’s family, who will decide how to manage their assets and creditors. Every will must contain the following information/items: 1) The testator must clearly identify himself or herself as the maker of the will, 2) The testator must declare that he or she revokes all previous wills and codicils, 3) The testator must demonstrate that he or she has the capacity to dispose of his or her property, and does so freely and willingly, 4) The testator must sign and date the will, usually in the presence of at least two disinterested witnesses (persons who are not beneficiaries) and 5) The testators signature must be placed at the end of the will. If this is not observed, any text following the signature will be ignored.
